Should Medical Devices be Entitled to Patent Extensions?

The European Commission is conducting a review of the extensions, which are granted via supplementary protection certificates (SPC), and will consider whether the legal framework for SPCs needs modernised – raising questions as to whether medical devices should be able to access SPCs. At present, the lack of access to SPCs is less of a problem for manufacturers of non-invasive and low-risk devices. However, for higher risk devices, there are more hurdles to overcome before the product can reach the market such as clinical trials and assessments which costs money and eats into the time that patent protection applies.
